Terms and Conditions

Pool Maintenance Terms & Conditions

The Parties agree that the Customer has entered into an agreement with Bayou Pools to perform pool and/or spa maintenance at the specified address. This is a weekly Service Contract, and the Customer agrees to pay Bayou Pools weekly, in advance of the services provided. If the Customer fails to pay in advance, as required by this Agreement, the Agreement will be terminated.

1. Service Frequency and Fees

Bayou Pools provides pool service once a week at the Customer’s address. The Customer agrees to pay a weekly pool service fee, depending on the chosen service level, in advance each week. The designated service date each week may vary due to scheduling, weather, or other factors. The Customer may request pool service twice a week for an additional monthly fee.

Circumstances, such as weather, illness, or holidays, may prevent Bayou Pools from performing maintenance. Bayou Pools may postpone service for up to 5 weeks each year; no services are provided during Thanksgiving and Christmas weeks.

In cases of inclement weather on the scheduled service date, the pool and spa will be cleaned to the extent weather permits, and only chemicals will be added.

The Customer must ensure Bayou Pools has access to the service area on the scheduled day, including gate entry codes, lock combinations, security guard verification, and relocating pets from the pool/spa area. If Bayou Pools cannot access the service area, services will not be performed that week, and the Customer will not be entitled to a credit.

Requests for additional services during the week are handled on a case-by-case basis and are not guaranteed. Additional trips incur a trip charge plus the cost of chemicals, billed at current market rates.

Vacation/Holidays: Bayou Pools will be closed for one week during the summer (Customer will be notified in advance), Thanksgiving week, and Christmas week. In emergencies, Bayou Pools will attempt to respond to calls and emails. Emergency services are provided at a separately agreed-upon rate.

2. Services

Bayou Pools provides the following services weekly, according to the selected service level:

Signature Service

  • Weekly service program
  • Test and balance pool water (*maintenance-level chemicals provided)
  • Empty skimmer and pump baskets
  • Check and empty automatic cleaners
  • Skim pool surface
  • Vacuum pool
  • Brush pool walls, tile, and steps
  • Backwash filters
  • Check pool equipment to verify operation
  • Monitor pool operations
  • Email a detailed report of each visit

Basic Chemical Service (Sunsetting – Existing customers only)

  • Weekly service program
  • Test and balance pool water (*maintenance-level chemicals provided)
  • Empty skimmer and pump baskets
  • Check and empty automatic cleaners
  • Backwash filters
  • Monitor pool operations
  • Email a detailed report of each visit

Basic Brush/Vacuum Service (Sunsetting – Existing customers only)

  • Weekly service program
  • Empty skimmer and pump baskets
  • Check and empty automatic cleaners
  • Vacuum pool
  • Skim pool surface
  • Brush pool walls, tile, and steps
  • Backwash filters
  • Monitor pool operations
  • Email a detailed report of each visit

Pools requiring chemicals above maintenance levels will incur additional charges at market rates at the time of service.

The Customer is responsible for maintaining proper water levels. The recommended level is mid-skimmer intake.

Cartridge filter cleaning is not included as a monthly service and is performed every 4 months for an extra fee unless additional cleanings are needed. Proper filter maintenance is required for effective service.

Standard service is billed at a half-hour rate, with additional labor billed at $19 per 15 minutes for services such as storm cleanup, excessive debris, algae, or any other extraordinary maintenance needs.

Heavy Rains: The Customer is responsible for “shocking” pool water after heavy rains between weekly services. If the pool is found untreated with algae growth, Bayou Pools will shock the pool at an additional cost.

Maintenance Chemicals Defined:

  • 3-inch chlorine tabs: up to 5
  • Liquid chlorine: up to 1 gallon
  • Calcium-hypochlorite: up to 3 pounds
  • Soda ash: up to 1 pound
  • Stabilizer (CYA): up to 1 pound
  • Muriatic acid: up to ½ gallon
  • Salt: 40 lbs

Bayou Pools uses advanced digital technology to test and analyze pool water and follows industry guidelines for dosing.

3. Repairs

Repairs are not included in the weekly service fee. Repairs under $50 will be completed immediately and billed separately. Repairs over $50 require Customer authorization before completion.

4. Pricing

The Customer agrees to pay Bayou Pools the weekly service fee and any additional costs for repairs, services, or chemicals beyond those specified in Section 2.

5. Payment

Bayou Pools accepts credit card payments only. Each weekly payment must be received in full before the first scheduled service for that week.

If the card on file fails to cover the weekly service fee and any additional charges, the Customer will be in default. In default, services are postponed, and the Customer incurs a $25 late fee. If unresolved, Bayou Pools is entitled to liquidated damages of $25 per week or one additional week’s service fee, whichever is less, to cover losses from the inability to fill the service void.

Credit card information is securely stored and used solely by Bayou Pools. By providing card details, the Customer authorizes Bayou Pools to charge the card on file for all services provided.

6. Disclaimer

Bayou Pools is not liable for property damage due to acts of nature, fire, vandalism, misuse, or abuse. The Customer should be aware of standard wear and deterioration from chemicals, sunlight, and corrosive materials like salt. The Customer is responsible for maintaining the correct water level. Bayou Pools is not responsible for damage or deterioration caused by the Customer’s failure to follow recommended maintenance or upkeep between visits.

7. Termination

This Agreement is a weekly service contract continuing from week to week until terminated. Either Party may terminate the Agreement. However, the Customer must give Bayou Pools three (3) days’ written notice of termination. Notice may be delivered in person, by email, or to Bayou Pools’ office.

8. Mediation

The Parties agree that any disputes arising under this Agreement will be submitted to the Fourth Judicial District Court in Louisiana for mediation or trial. This Agreement is governed by Louisiana state law.
